Due Process

On one's own behalf

Many legal processes now require electronic filing. These filing processes and systems represent a great potential concern when it comes to preserving the integrity of our system of Law and Order and also protecting the information of people engaged in and through legal processes.


We need to develop and implement standards and requirements regarding electronic legal filing processes, including development of appropriate oversight and monitoring as well as a compliance standard for electronic legal filings.


We also need to develop a judicial process mechanism to pre-declare potential conflicts of interest in specific filings so as to prevent abuse of the legal filing process in acts of money laundering and other crimes.


We also need appropriate capital support for pro se filers so that the “legal capital” that lawyers have access to in terms of multiple cases at once is not used to obstruct pursuit of justice for one exercising their legal right to represent themselves in court.
